Acceptable Use Policy
Send messages people want to receive
SwarmSMS is a tool for sending text messages through your own phones. You are responsible for how you use it. This policy sets out what is not allowed. Breaching it can lead to suspension of your license without refund.
1. Consent first
- Only send marketing messages to people who have given you clear permission. Do not use purchased, scraped or rented lists.
- Keep a record of when and how each person opted in (SwarmSMS records the source and time automatically).
- Identify your business in your messages and give an easy way to opt out. Honour STOP requests immediately. Do not re-subscribe people who have opted out.
2. Follow the law
You must comply with the laws that apply to you and your recipients, which may include the Australian Spam Act 2003 and Do Not Call Register Act 2006, the US Telephone Consumer Protection Act (TCPA) and CAN-SPAM-related rules, GDPR and PECR, and local telemarketing and sending-hour restrictions. Use the sending-hours and opt-out features, and take your own advice where unsure.
3. Prohibited content and activity
- Spam, unsolicited bulk messages, chain messages or messages designed to evade filters or carrier controls.
- Phishing, scams, fraud, impersonation or misleading sender identity.
- Threatening, harassing, hateful or abusive messages, and content that is unlawful or exploits or endangers minors.
- Illegal goods or services, unlawful gambling or lending promotions, and anything regulated that you are not licensed to promote.
- Using SwarmSMS to send one-time codes or messages on behalf of others to bypass their security or verification systems.
- Interfering with the licensing service, sharing license keys publicly, or using a license on more sites than your plan allows.
4. Carrier and platform rules
Your mobile carrier’s terms and fair-use rules apply to the SIM plans you use. Respect them: use message gaps, rate limits and daily limits, and do not use consumer plans for volumes they don’t permit. We are not responsible for carrier decisions, blocked numbers or charges.
5. Enforcement
If we reasonably believe a license is being used in breach of this policy we may suspend or terminate it, without refund, and may cooperate with authorities where required by law.
6. Reporting
To report abuse involving SwarmSMS, use the contact form and put “Report abuse” in the topic.
