Terms of Service
Last updated: 18 October 2026
These terms apply to your use of the SwarmSMS WordPress plugin, the SwarmSMS Android app and the swarmsms.com website and store (together, the “Service”), provided by Boost Solutions (“we”, “us”). By purchasing, installing or using the Service you agree to these terms.
1. The Service
SwarmSMS lets you send and receive text messages through Android phones that you own or control, and manage contacts, campaigns and automations in your own WordPress site. Messages are sent through your own mobile plans; we do not carry, store or have access to your messages.
2. Licenses and subscriptions
- A license is sold as an annual subscription (Basic, Pro or Agency) and renews automatically until cancelled. Prices are shown at checkout.
- Each license allows activation on the number of WordPress sites stated for your plan. You may deactivate a site and re-activate on another.
- A license covers updates, support and new site activations while the subscription is active. When the subscription ends, the plugin and the Android app keep working with the features of the plan you bought, but you will not receive updates or support until you renew. Your data always remains in your site. A purchase that is refunded or revoked ends the license and the plugin returns to the after-trial limits (10 messages a day).
- The plugin’s source code is released under the GNU General Public License v2 or later. The license you buy covers the right to receive updates, support, the Android app and use of our licensing service; it does not restrict the freedoms granted by the GPL.
- You may not share your license key publicly or use it on more sites than your plan allows.
2A. SwarmSMS Cloud
- SwarmSMS Cloud is a hosted service on the same yearly plans as the SwarmSMS Plugin for WordPress (Basic, Pro and Agency); one purchase covers both. A new account gets a 1-day trial with every feature. After the trial, without a plan, the account is limited to 1 device and 10 outgoing messages a day; if you reach a limit, new sends are refused until the next day or until you choose a plan.
- Messages are sent by Android phones that you own and control, using your own SIM plans. You are responsible for your carrier’s terms, for fair use of your plan, for having consent to message each recipient, and for following the Acceptable Use Policy.
- We may suspend or limit an account that breaks the Acceptable Use Policy or puts the service at risk. You can delete your account at any time from the dashboard (Account → Delete account); this erases its data straight away and cancels any active plan. Deleting an account is not a refund.
- SwarmSMS Cloud and the SwarmSMS Plugin for WordPress are separate products with separate plans: a licence for one does not unlock the other.
- We aim to keep Cloud available but do not promise uninterrupted service, and message delivery depends on your phone, its signal and your carrier.
3. Your responsibilities
- You are responsible for the content of the messages you send, for having the recipients’ consent where required, and for complying with all laws and carrier rules that apply to you and your recipients (including the Australian Spam Act 2003, the US Telephone Consumer Protection Act, GDPR and PECR as relevant).
- You must follow our Acceptable Use Policy.
- You are responsible for your phones, SIM plans, carrier charges and any carrier fair-use or spam policies.
- You are responsible for the security of your WordPress site, your API keys and your Firebase credentials.
4. Payments, renewals and refunds
Payments are processed by PayPal. Subscriptions renew each year on the anniversary of purchase unless you cancel in your account before renewal. New purchases are covered by our 7-day money-back guarantee; see the Refund Policy.
5. Availability and changes
We aim to keep the licensing service and downloads available but do not guarantee uninterrupted service. We may change or discontinue features with reasonable notice. Message delivery depends on your phones, your carriers and the recipients’ networks and is outside our control.
6. Warranty disclaimer
Except as required by law (including the Australian Consumer Law, which cannot be excluded), the Service is provided “as is” without warranties of any kind, including fitness for a particular purpose and uninterrupted or error-free operation.
7. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect or consequential loss, loss of profit, loss of data, carrier charges, blocked numbers or regulatory penalties arising from your use of the Service. Our total liability for any claim is limited to the amount you paid for your license in the 12 months before the claim. Nothing in these terms limits rights you have under law that cannot be excluded.
8. Suspension and termination
We may suspend or terminate a license, without refund, if it is used to send unlawful or abusive messages, breaches the Acceptable Use Policy, or is shared beyond the permitted number of sites. You may cancel at any time.
9. Privacy
Our handling of personal information is described in the Privacy Policy.
10. Governing law
These terms are governed by the laws of Australia. You submit to the non-exclusive jurisdiction of its courts.
